At the economic and political levels, the issue of public service employee financial disclosure is an important and sensitive issue. Its value tends to be that it specifically impacts the public employee's personal freedoms. Subsequently, the great effects of administrative and financial corruption, behind which there is political corruption, which is the engine of the two previous forms. It has become important to balance the personal freedoms and security of the public servant's personal information and the duty of transparency and financial disclosure. Normally, this duty can only be accomplished by legal mechanisms.

من المفترض أن أي إجراء ضبطي تقوم به الإدارة العامة يجب أن يتوافق مع قواعد المشروعية, وخصوصاً موضوع الإستيقاف الإداري لكونهِ نشاط له تأثير مباشر في حقوق الأفراد وحرياتهم, ناهيك عن أنَ الادارة العامة كثيراً ما تلجأ لإستخدام هذا الإجراء في الوقت الحاضر متذرعةً بهدف صيانة النظام العام, فقد تنحرف الإدارة بإستخدام سلطتها لتحقيق أهداف شخصية بعيداً عن ما هو مقرر لها، لذلك أصبح لزاماً تدخل القضاء ومراقبة مدى مشروعية قرارات الإستيقاف الإداري من حيث عيب الإختصاص والشكل والإجراءات والسبب والمحل والهدف أو الغاية, وتمتد في بعض الأحيان لمراقبة عنصر الملائمة في الظروف العادية أو حتى الاستثنائية في حالات محددة, ولأهمية موضوع الاستيقاف الإداري لابُدَ أن يكون هناك نظام قانوني يصدره المشرع ينظم به نشاط الادارة العامة بهذا الصدد, من أجل ضمان عدم الإنحراف بإستخدام السلطة ولا يكون ذلك إلا تحت رقابة القضاء.
