تهدف الدراسة الى نقد المبادئ الاساسية الواردة في دستور جمهورية العراق لعام 2005 النافذ في ضوء فلسفة هيجل للقانون، لإيجاد الجانب العقلاني والفكرة الفلسفية الموحدة في النص الدستوري، وتسليط الضوء على الجوانب التي غابت عنها تلك الصفات، من خلال اجراء مقايسة فلسفية بين فلسفة القانون عند هيجل والمبادئ الاساسية في الدستور العراقي التي خصص لها الدستور بابا كاملا هو الباب الاول.
اعتمدت الدراسة فلسفة هيجل بشكل عام وفلسفة القانون عنده بشكل خاص من خلال مؤلفاته ولاسيما كتابه الابرز في هذا المجال (اصول فلسفة الحق). كما حاولت الدراسة ايجاد المبرر الفلسفي لاختيار فلسفة هيجل مقياسا للدراسة من بين فلسفات القانون، لما فيها من عقلانية وشمول ومقاربة تاريخانية مع الواقع العراقي، وقد قسمت الدراسة المبادئ الاساسية الى مبادئ ذاتية وهي شكل الدولة ونظام الحكم والتداول السلمي للسلطة، وأخرى موضوعية وهي الحقوق والحريات ودين الدولة ولغة الدولة.
تفترض الدراسة وجود مشكلات فلسفية ومنطقية قانونية في النص الدستوري لدستور 2005، تكمن في المبادئ الأساسية للدستور، وفي تطبيقات تلك النصوص في الواقع السياسي القانوني للدولة، على فرض ان المشكلات التي اقترنت بالتطبيق العملي لبنوده والخلافات التي صاحبت ذلك التطبيق ترجع في مردها الى افتقار المبادئ الأساسية للدستور العراقي إلى النظرة الكلية والفكرة الشاملة المضبوطة منطقياً والتي يوفرها العقل الفلسفي، ذلك ان تحرص دائماً على ان تكون متبنياتها ومقدماتها ونتائجها تتصف بقدر كافٍ من المعقولية والصدق المنطقي. وعليه نشرع في هذا البحث بمقايسة المبادئ الاساسية في الدستور العراقي مع البناء الفلسفي للقانون الذي وضعه هيجل.
وقد خلصت الدراسة الى وجود مشكلات فلسفية في نص الدستور العراقي، منطقية ونظرية وتطبيقية، ما يساهم ابرازها أمام المشرع والمفكر العراقي في ايجاد حلول عقلانية لتلك المشكلات.
فعلى الرغم من ان الدستور قد أخذ مبادئه من فلسفات قانونية معروفة، إلا أن هناك مشكلة في الترابط الفلسفي بين تلك المبادئ لاختلاف منابعها الفلسفية واصولها، فضلا عن مشكلة في طريقة صياغتها منطقيا، فالتعارض في بعض نصوص الدستور العراقي، يخلق حالة من الفوضى الفكرية، فضلا عما يثيره من مشاكل سياسية وقانونية.
The study aims to criticize the fundamental principles contained in the Constitution of the Republic of Iraq for the year 2005, in force in the light of Hegel's philosophy of law, to reveal the rational side and the unified philosophical idea in the constitutional text, and to highlight the aspects that are absent from these characteristics, by conducting a philosophical comparison between Hegel's philosophy of law and the fundamental principles of the Iraqi constitution, for which the constitution has devoted a whole chapter, is the first chapter.
The study adopted Hegel's philosophy in general and his philosophy of law in particular, through his writings, especially his most prominent book in this field (The Principles of the Philosophy of Right). The study also tried to find the philosophical justification for choosing Hegel's philosophy as a criterion for the study among the philosophies of law, because of its rationality, comprehensiveness, and historical approach to the Iraqi reality. The study divided the fundamental principles into subjective principles which are the state shape, the regime and the peaceful transfer of power, and the objective principles which are the rights, freedoms, the state religion and the state language.
The study assumes that there are philosophical and logical legal problems in the constitutional text of the 2005 constitution, which lie in the fundamental principles of the constitution, and in the applications of those texts in the political-legal reality of the state, on the assumption that the problems that were associated with the practical application of its provisions and the controversies that accompanied that application are due to the lack of fundamental principles the Iraqi constitution has the logically correct and inclusive view provided by the philosophical mind, so that it is always keen to ensure that its adoptions, premises, and results are characterized by a sufficient degree of reasonableness and logical truth. Accordingly, we proceed in this research by comparing the fundamental principles of the Iraqi constitution with the philosophical structure of the law that Hegel had put.
The study concluded that there are philosophical problems in the text of the Iraqi constitution, logical, theoretical and applied, where highlighting them before the Iraqi legislator and thinker contributes in finding rational solutions to these problems.
Although the constitution has taken its principles from well-known legal philosophies, there is a problem in the philosophical interdependence between those principles due to their different philosophical sources and origins, as well as a problem in the way they are formulated logically, as the contradiction in some texts of the Iraqi constitution creates a state of intellectual chaos, in addition to the political and legal problems it raises.
